This week former Labor Upper House leader Bernard Finnigan appeared before Justice Smart represented by Michael Abbott, QC to answer 14 charges that between 2010 & 2011 he did knowingly download child sex images from the internet. Mr. Finnigan who was touted to be the next Premier of our great state until his arrest on these charges is using the defense put forward by the honorable Mr. Abbott that because the child sex images are nameless, they are therefore victimless since no one can prove their age since the children are not able to be located.
Really, Mr. Abbott, you were once my attorney on several matters and I considered you an ethical practioner of the law, but this argument would be laughable if it was not an insult to survivors of monsters like Finnigan everywhere. To suggest that because a photo is years old and the apparent victim cannot be located, it is therefore not a crime, is akin to saying that pictures showing atrocities against the Jewish people during the Nazi holocaust, means the holocaust was victimless because the victims no longer live. Are you getting that old Mr. Abbott that this purile form of game playing is the best you can do? It has long been a known fact that there is a worldwide trade in the swapping of photos internationally of small children being subjected to the worst kind of molestation by monsters and just because Mr. Finnigan’s pictures may show victims of another race, from another place or time makes it no less a crime for him to gain sexual gratification from these pictures.
If South Australia falls for this disgusting attempt to decriminalize Pedophilia in whatever form it presents, either viewing or actual acts, then the law truly has become an ass and there is no hope for decent people to gain justice for horrors they have suffured. This is not my last comment on this subject and if Mr. Finnigan walks free, I and a network of great people back in Adelaide will make it our duty to see his name and his true nature is made aware to all.
